14 October 2011 List of documents required for privatising or acquiring leasehold of land plots under buildings and structures is updated.

Goltsblat BLP advises that an updated list of documents required for privatising or acquiring leasehold of land plots under buildings and structures is introduced by order No. 4751 of 13 September 2011 of the Ministry for Economic Development of the Russian Federation.  The list is not drastically different from its 2007 version although, on the whole, the requirements it specifies are more flexible.

• It reflects the current policy of expanding the scope of information liaisons between various state departments and specifies that certain documents required for acquiring the title to land plots may not be requested from applicants.

These include: extracts from the Realty and Company Registers and information from the real estate cadastre. If an applicant does not attach them to its application for the title to a land plot, the competent authority must request them itself.   

Furthermore, application of these rules to land plots owned by constituent entities of the Russian Federation or municipalities or that are in undelimited state ownership is postponed until 1 July 2012.

• The special requirements on the statute of limitations for attached extracts from the Realty Register and the real estate cadastre are also revoked, as is the requirement for land plot cadastral passports to describe all parts thereof that are occupied by real property items.
• The list is supplemented by a notification from the applicant enumerating all buildings, structures and works located on the land plot for which the title is requested.

Order No. 475 of the Ministry for Economic Development comes into effect on 16 October 2011.
