Goltsblat BLP advises of adoption of Federal Law of 12 December 2011 No. 427-FZ "On Amendment of Articles 2 and 3 of the Federal Law 'On Introduction of the Land Code of the Russian Federation'" and certain legislative acts of the Russian Federation (the Law).

The Federal Law "On Introduction of the Land Code of the Russian Federation" is supplemented by a rule entitling the owner of construction in progress whose title thereto is registered before 1 January 2012 to lease a state or municipally-owned land plot on which the given facility is located, without the need for a tender, in the manner established for formalisation of rights to land plots by owners of buildings and structures.

The sphere of application of this rule is not quite clear, since registration of ownership title to construction in progress is, according to the general rule, only possible given rights to the land plot.
